Dalam PP Manajemen PNS disebutkan, PNS yang dipensiun dini mendapat hak kepegawaian sesuai dengan ketentuan peraturan perundang-undangan,"
Sebaliknya, bagi PNS berusia 50 tahun dengan masa kerja kurang dari l0 tahun, diberi uang tunggu paling lama lima tahun. Apabila sampai dengan lima tahun PNS itu tidak bisa disalurkan, maka akan diberhentikan dengan hormat dan diberikan hak kepegawaian sesuai dengan ketentuan peraturan perundang-undangan.
“Bagi PNS yang tidak bisa disalurkan ke instansi lain tapi saat berakhirnya pemberian uang tunggu yang bersangkutan belum berusia 50 tahun, jaminan pensiun bagi PNS mulai diberikan pada saat mencapai usia 50 tahun,” tegas Kepala Biro Hukum dan Komunikasi Informasi Publik Kementerian Pendayagunaan Aparatur Negara dan Reformasi Birokrasi (KemenPAN-RB) Herman Suryatman.
